A bathroom remodel in Scarsdale, NY runs under Village rules rewritten since late 2022: the building chapter was adopted in December 2022, the sewer article that tests house laterals in February 2023 and the noise chapter in July 2023. By the County's directory, the Village Building Department is at 1001 Post Road. The houses are older than the rules. Westchester County Planning's year-built table, which counts occupied homes from ACS 2013-2017 estimates, dates 2,822 of Scarsdale's 5,782 to 1939 or earlier and sets the median year built at 1941. Scarsdale's 2022 building code, the tile-cutting pause and the lateral test

Section 132-8 requires a building permit for construction, alteration and repair unless the chapter exempts the work. Applications go on forms the Building Inspector provides, with at least two sets of construction documents, and an application not completed within 90 days of filing is deemed abandoned. Building, plumbing and electrical permits expire six months after issue if work has not begun, and two years after issue in any event, and the permit stays visibly displayed at the house until the work is complete. The applicant estimates the construction cost and pays a fee set by Board of Trustees resolution, and the cost figure on the application is the one in our written estimate.

Section 132-45A asks that a requested inspection be made within 24 hours of the request whenever possible, weekends and holidays excluded. The stages run from the work site before the permit issues, through framing and the structure, wiring, plumbing and mechanical systems, to Energy Code items such as insulation and a final inspection. Electrical work is inspected by a New York State authorized agency, with the application for that inspection filed with the Village under section 132-53. At the end, the permit holder files an affidavit that every inspection requirement has been met, and the code makes a false affidavit a crime. The certificate of use and occupancy then needs a sworn statement from a person familiar with the work and an affidavit of the final cost.

Chapter 205 sets the hours. Construction, repair and demolition tools may run Monday through Friday between 8:00 a.m. and 6:00 p.m. and on Saturday between 10:00 a.m. and 5:00 p.m., never on Sundays or legal holidays except for emergency work, and motorized equipment must run with a muffler. Section 205-4G gives stone and tile cutting the same windows and adds a pause: all stone and tile cutting must cease for one hour within every three hours of operation, to give the surrounding community respite. On a bathroom tile installation we cut slab and large-format porcelain in batches around that hour and keep setting tile while the saw is off.

The sewer chapter adds a step before larger jobs. Under section 244-14A, an owner must have the sewer lateral televised or pressure-tested and obtain a discharge compliance certificate before a building permit issues for substantial work, which section 244-10 defines by a construction-cost line for residences; the same test applies whenever the property is sold or transferred. Scarsdale's sewers feed the County trunk sewer system and County treatment plants that discharge into Long Island Sound. Debris leaves with the contractor: the Sanitation Division does not accept construction and demolition debris such as tile and Sheetrock, and a container in the street needs a written permit from the Village Engineer.

Flood rules sit in Chapter 167, adopted in 2007, which treats any improvement costing 50% or more of a structure's market value as a substantial improvement and names the Village Engineer as local administrator for floodplain development permits. The Hutchinson River begins at Brookline Avenue in Scarsdale, and the October 2024 update of the Bronx River watershed plan, which includes Scarsdale, shows the Bronx River Parkway flooded by Hurricane Ida in 2021. The Board of Architectural Review looks at changes to exterior character and appearance; neither its referral list nor its design guidelines mention interiors. The Village has its own water department, and Veolia's Westchester rate districts list no Scarsdale municipality. The Scarsdale station sits on the Harlem Line between Crestwood and Hartsdale, and Wayside Cottage on Post Road entered the National Register in 1981.

Does replacing a toilet or vanity in Scarsdale need a permit?

Not always the full application. Section 132-9A lets the Building Inspector permit the replacement of plumbing fixtures without the application when no water supply or drainage piping is altered or disturbed, and tiling and the removal of stoppages sit on the same list. A vanity and countertop set on the existing connections can fall under it; a moved drain, a new circuit or an opened wall cannot. We confirm which side of that line a job sits on with the Building Department before the contract is signed.

What do the asbestos and lead rules mean for an older Scarsdale house?

The asbestos question turns on January 1, 1974: if original construction began before that date, the Labor Department's Rule 56 requires a survey of the area to be remodeled before work starts, with one copy for the Building Department and one for the site. The lead question turns on 1978: in an older house, the EPA treats anything beyond six square feet of disturbed paint in a room as renovation, bars open-flame burning of paint and allows power sanding or grinding only with shrouds and a HEPA vacuum attachment.
